Jesse Caryl primarily concentrates his practice on employment litigation, including wage and hour claims, discrimination and harassment claims, and wrongful terminations in violation of public policy. Jesse’s experience also includes defending employers in wage and hour class actions ranging from fifty to tens of thousands of putative class members. In addition to state and federal courts, Jesse represents clients in matters pending in state and federal administrative agencies, including the California Department of Fair Employment and Housing (DFEH), California Division of Labor Standards Enforcement (DLSE), U.S. Equal Employment Opportunity Commission (EEOC), U.S. Department of Labor (DOL), and National Labor Relations Board (NLRB).
Jesse regularly advises employers on all aspects of employment law, such as drafting employment policies and handbooks, handling employee discipline and termination matters, and drafting severance agreements. Jesse has also published several articles concerning compliance with the Fair Labor Standards Act and California Labor Laws regarding a variety of wage and hour issues. Jesse further serves as a panel speaker for several continuing education courses for California attorneys, and routinely provides sexual harassment and management trainings in a wide range of industries. During law school, Jesse served as the Literary Editor for the Pepperdine Law Review, and received the Am Jur Award for Labor Law.
Representative Experience
● Represented a national restaurant chain in a wage and hour putative class action involving more than 10,000 current and former employees in California. Obtained denial of class certification on behalf of the company.
● Represented a national staffing agency in a sexual harassment, discrimination and retaliation lawsuit by a former employee. Obtained summary judgment and dismissal on behalf of the company. Following the dismissal, obtained a judgment against the former employee for costs associated with defending the action.
● Represented an international restaurant chain regarding the return of valuable Hollywood memorabilia. Obtained a temporary and permanent order from the Court for the return of the client’s property. The returned items, many of which were one of a kind, represented a hard fought victory for the client.
● Represented an individual and international construction firm in a defamation and wrongful termination lawsuit. Obtained summary judgment and dismissal of the claims on behalf of the clients.
● Represented a local public entity regarding a temporary restraining order brought against a current employee. Obtained a dismissal of the restraining order and a judgment against the individual seeking the restraining order for the attorneys’ fees associated with defending the matter.
● Represented a hospital and supervisor in a wrongful termination, harassment, discrimination and retaliation lawsuit. Obtained summary judgment on behalf of the clients.
● Successfully litigated dozens of wage and hour class actions in state and federal courts.
